HowTests Copyright & DMCA Policy

At HowTests, we respect and uphold intellectual property rights in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. As a platform that supports user contributions, editorial publishing, and automated educational tools, we take copyright protection seriously. This policy outlines the rights and responsibilities of content owners, contributors, and HowTests in matters related to copyright compliance.

Copyright Compliance and Contributor Responsibilities

All users, including authors, educators, editors, and task submitters, are required to ensure that their contributions (text, media, visuals, or AI-supported drafts) are

  • Original or legally licensed for publication on HowTests.
  • Properly attributed when referencing third-party materials under fair use or with permission.
  • Free from any infringement of third-party copyrights, trademarks, or moral rights.

By submitting content, users affirm that

  • They are the copyright holders or authorized licensees of the material.
  • The content is not taken from copyrighted books, question banks, or proprietary sources.
  • Visuals (images, diagrams, charts) are either self-created, royalty-free, or properly licensed.

Content found to be infringing may be removed immediately and may result in account restrictions.

AI-Assisted and Editorially Refined Content

HowTests permits the use of AI tools to support content drafting; however, AI-generated content must be fully reviewed, edited, and validated by the user before submission.

The use of AI must not involve copying AI outputs from external models trained on copyrighted content.

All final submissions are reviewed by HowTests editors and may be refined or adapted to meet originality and quality standards.

Filing a DMCA Takedown Notice

If you believe your copyrighted work has been posted on HowTests without authorization, you may submit a DMCA Takedown Notice.

Your notice must include

  • A detailed identification of the copyrighted work.
  • The direct URL or location of the infringing material on HowTests.
  • Your full legal name, mailing address, email, and phone number.
  • A sworn statement that "I have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law."
  • A declaration under penalty of perjury that your claim is accurate.
  • Your physical or electronic signature.

Upon receipt of a valid notice

  • The infringing content will be promptly removed or disabled.
  • The user who submitted the content will be notified and given the opportunity to respond with a Counter-Notification.

Submitting a DMCA Counter-Notification

If you believe your content was wrongly removed due to a DMCA notice, you may submit a Counter-Notification. Your response must include

  • Identification of the removed content and its original URL.
  • Your full legal name, mailing address, email, and phone number.
  • A statement, under penalty of perjury, that "I have a good faith belief that the content was removed or disabled as a result of mistake or misidentification."
  • A statement that you consent to the jurisdiction of the courts in your legal district and accept service of process from the original complainant.
  • Your physical or electronic signature.

Once received

  • The complainant will be notified.
  • The removed content may be reinstated within 10 business days unless the complainant initiates a legal proceeding.

Repeat Infringement Policy

To protect platform integrity, HowTests enforces a zero-tolerance policy against repeated copyright violations. A "repeat infringer" is any user who receives multiple valid DMCA notices within a defined period.

  • Suspension or permanent termination of the contributor account.
  • Blocking of future submissions.
  • Notification to affiliated platforms (e.g., Howfiv, CSSPrepForum) for coordinated enforcement.

False Claims and Legal Accountability

Pursuant to 17 U.S.C. § 512(f), any party who knowingly submits a false claim of infringement may be liable for damages, including legal costs.

If you are uncertain whether content violates your copyright, seek legal counsel before filing a claim.

Submitting a DMCA notice or counter-notice without merit may result in civil penalties.

Scope of Protection and Platform Integration

This policy applies to all content on HowTests, including

  • MCQs, writing tasks, and articles.
  • Visual content embedded within user dashboards.
  • Author profiles and shared educational templates.
  • Integrated cross-platform content (e.g., reposted materials from CSSPrepForum or Howfiv).

Users submitting shared or collaborative content across platforms are required to ensure the original author is acknowledged and proper reuse permissions are granted. However, the content published by HowTests' team or administration does not fall under this jurisdiction.

Policy Updates and Review

HowTests reserves the right to revise this policy to reflect changes in the following.

  • The US or international copyright law.
  • Platform features, such as AI workflows or collaborative publishing.
  • Content types, including new media formats or distribution channels.
